I acknowledge and agree to the following terms and conditions in consideration of being allowed to enter and participate in activities at Little Neck Swim and Racquet Club (LNSRC): Assumption of Risks: I understand and acknowledge that participation in activities at LNSRC involves inherent risks, including but not limited to, the risk of personal injury, illness, property damage, or loss. Release of Liability: agree to fully and forever waive, release and discharge LNSRC and/or it’s owners from any and all claims, actions, causes of action, demands, judgments, damages (including compensatory, general, special, consequential, exemplary and punitive), liability or obligations of any nature or kind, whether known at the time I leave the club or which may arise or become known later, which accrue on account of, or in any way arise out of or in connection with: (a) my activities within the club; (b) the activities within the club by others; (c) the operation of the club by the board regardless of whether such claims are founded in whole or in part upon alleged negligence, or the actual negligence of club board; (d) my use of any and all of the club facilities; and (e) my use of any and all equipment within the club, whether owned by me, LNSRC or a third party. Indemnification: I agree to indemnify and hold harmless the Little Neck Swim and Racquet Club, its board members, employees, volunteers, agents, and any vendors including the food truck operator, from any loss, liability, damage, or costs, including attorney’s fees, that they may incur arising out of or related to my participation in the activities at the club. Responsibility of Sponsoring Member: I understand that as a guest of Little Neck Swim and Racquet Club, the sponsoring member is responsible for my actions, damages caused by me, and ensuring my compliance with all rules and regulations of the club. I agree to abide by all club rules and regulations during my visit. Photographic Release: I hereby grant permission to the Little Neck Swim and Racquet Club and its authorized representatives to take photographs or videos of me during my visit. I authorize the use of these photographs or videos for any legal purpose, including but not limited to publicity, copyright purposes, illustration, advertising, and web content. Waiver of Claims Against Other Participants: I acknowledge and agree that I waive any claims or causes of action against other participants of Little Neck Swim and Racquet Club for any injury, damage, or loss that I may sustain as a result of my participation in club activities. Acknowledgment of Understanding: I have read this waiver and release form fully and understand its contents. I am aware that by signing this document, I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily. WE HAVE A ZERO TOLERANCE FOR THE BELOW BEHAVIORS: Bullying Name Calling Swearing Racial Slurs or Discriminatory Comments Inappropriate Language or Gestures Fighting or Disorderly Conduct Mistreatment of Our Staff or Guests Violation of any safety standards or rules I fully understand that participating in the activities within the club involves physical exertion; and accordingly represent that I am in sufficient good health to participate in activities within the club; I do not have any pre-existing physical or medical condition, including without limitation pregnancy, orthopedic problems, including back problems; heart problems; and/or breathing problems, that might be impacted or worsened by my use of the club; and will not use the club and its facilities while under the use of any drugs, alcohol or medications that may impair my physical abilities or judgment. I have read and understand the terms of this WAIVER, RELEASE AND ASSUMPTION OF RISK AGREEMENT and unconditionally agree to its full terms, statements, warranties, notices, representations, waivers and releases on behalf of both myself and marital community, if any, and my child or ward, whose name is listed on the form and have certified all information is accurate and to the best of my knowledge. I am of right mind and under no pressure to agree to the terms of this agreement. If the participant is under 16 years of age, a parent or legal guardian or member that has accompanied the child must also sign below. My submission is considered my signature.(Required)

I fully and unconditionally agree to the waiver, release and assumption of risk agreement and also do so for any additional minors (if applicable) listed. I also fully and unconditionally agree to all club pool rules.
